Can Copyright Infringement Really Be Positive?

 

However, this unfortunate interaction doesn’t always have to be an unpleasant experience. Copyright infringement can be a positive experience. Yes, you read that correctly, dealing with copyright infringement can be a positive experience. Actually, the more pleasant your experience while dealing with copyright infringement, the more likely you’re dealing with a legitimate copyright infringement case.

 

Thinking about it logically, it makes sense. If you’re approached by a copyright troll or scam, what’s the first thing they’re going to want from you? Money. With trolls and scams, that’s their entire goal. So, it makes sense that they will be aggressive and demand payment right off the bat. However, with a real copyright infringement case, they probably just want you to remove the image in question or pay them for licensed use. Do you see the difference?

 

 

Copyright Infringement Trolls And Scams

 

In our experience, we have seen more copyright trolls and scams, than we have legitimate copyright cases. Copy right trolling happens as a response to an individual using image or textile patterns that don’t belong to them. The “trolling” or “scamming” party attempts to enforce copyrights that they or their clients hold. The whole purpose is to make money through litigation, and not necessarily stop the use of their imagery.

 

As you can see in the image below, they attempted to extort $950.00 from another business that reached out to us. Usually, their efforts are abnormally aggressive or manipulative. Most of the time, they cannot produce licensing for the images in questions themselves. Copyright trolls depend on quantity. If they cast a wide enough net, they’re bound to get some fish into the boat.

 

 

Dealing With Copyright Infringement Can Be A Positive Experience

 

When you’re dealing with a legitimate case of copyright infringement, most likely, the interaction will be more on the positive side. Instead of being bum rushed with accusations, threats, and demands, they’ll probably just notify you of your infringement and offer solutions to rectify the issue.

 

Recently we saw this sort of case. We were contacted by someone looking for guidance with this issue, as we often are, and we were able to notice the difference immediately. This legitimate infringement issue is showcased in the image below. You can clearly see and hear the passive tone and approach that was taken. They didn’t demand payment or make threats, instead they said, “just to let you know…” and “please remove the image or purchase a license” etc.

 

In this case the image in question was removed from the website and a courteous email was sent as a reply. Once the image in question was removed, the initiating company was sent a reply to their infringement email. Basically, the email stated that the image had been removed and they were issued an apology. The initiating company responded one last time to say that the case had been closed and that was it. Simple, civil, and quick. So, copyright infringement can be a positive experience.
